Terms of Service

These Terms of Service ("Terms") govern your access to and use of PodSpark (the "Service"), provided by PodSpark ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use PodSpark.

Eligibility & account

You must be at least 13 years old (or the age of digital consent in your country) to use PodSpark. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at officialmspmedia@gmail.com if you suspect unauthorized access.

Subscriptions & billing

Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time from Billing; cancellations take effect at the end of the current period and we do not provide refunds for partial periods, except where required by law. Prices and features may change with reasonable notice.

Acceptable use

You agree not to:

  • Violate any law or infringe anyone's intellectual-property, privacy, or publicity rights.
  • Upload malware, attempt to breach security, or interfere with other users' use of the Service.
  • Use PodSpark to generate or distribute content that is illegal, harassing, defamatory, hateful, sexually explicit involving minors, or designed to mislead.
  • Scrape, resell, or reverse-engineer the Service, or use it to train competing AI models.
  • Exceed reasonable usage limits or share an account across separate users.

Your content

You retain all ownership of the content you upload, create, or generate using PodSpark ("Your Content"). You grant us a worldwide, non-exclusive license to host, copy, transmit, display, and process Your Content solely to operate, secure, and improve the Service for you. You are responsible for ensuring you have the rights to Your Content.

AI-generated output

AI features generate suggestions based on your prompts. Output may be inaccurate or similar to results returned to others, and is not legal, medical, or financial advice. You are responsible for reviewing AI output before publishing or relying on it.

Our intellectual property

PodSpark, including its software, design, and branding, is owned by us and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms.

Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your account if you breach these Terms or if continued operation would expose us or other users to legal or security risk. Upon termination, your right to use the Service ends; sections that by their nature should survive (e.g., ownership, disclaimers, limits of liability) will continue to apply.

Disclaimer & limitation of liability

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months preceding the claim, or USD $100, whichever is greater.

Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or in-app before they take effect. Continued use of the Service after the changes take effect constitutes acceptance.
